Delaware Superior Court dismisses lawsuit challenging state’s participation in RGGI

On 26 June 2018 Delaware Superior Court Judge Stokes dismissed a lawsuit challenging Delaware’s participation in the Regional Greenhouse Gas Initiative (RGGI) against the Department of Natural Resources and Environmental Control of Delaware. The plaintiffs, three citizens, claimed that RGGI would increase their electricity bills. Judge Stokes dismissed the suit stating that they had not provided sufficient evidence for this claim. Delaware has been part of RGGI, a linked carbon market covering the power sector of nine participating US states.
